I bought a commercial property and paid 12% GST on it. I leased out the property and charged GST on the rent. Can I claim ITC of the gst paid on purchase of this property.

I bought a commercial property and paid 12% GST on it. I leased out the property and charged GST on the rent. Can I claim ITC of the gst paid on purchase of this property.

Reply—A registered person is not eligible to take input tax credit in respect of goods and services used for Construction of immovable property (section 17(5)(d) of CGST Act).

However as there is no restriction on taking ITC on purchase of immovable property, ITC for purchase of commercial property is available if used for business. Renting of property is not covered under business.
