Sec. 145 of the Income-tax Act, 1961 — Method of accounting — IT Appeal of the assessee was admitted on the question as to "whether under the garb of rejection of books of accounts, huge trading additions can said to be legally justifiable when the defects pointed out, if any, were minor defects and no defect was pointed out in the opening stock, purchases, sales, closing stock and stock-register." High Court dismissed the appeal of the assessee holding that “it is not appropriate to decide the present appeal on merits as the fresh assessment/remand order has been passed in terms of the order of ITAT in which the appellant had opportunity to participate in the proceedings and put his case before the AO.
