Section 132 of the CGST Act, 2017 — Bail – The applicant prayed for regular bail for the offences punishable u/s132(1)(b) and 132(1)(c) of the Act. The counsel of the applicant submitted that considering the nature of the offence, the applicant may be enlarged on regular bail by imposing suitable conditions. The respondent counsel opposed grant of regular bail looking to the nature and gravity of the offence. The court observed that the applicant is in jail since 18.07.2019. The investigation is over and chargesheet is filed. The applicant has shown willingness to deposit Rs. 1 crore within a period of 12 months from the date of his actual release. Other coaccused have been enlarged on bail. The Court has relied the law laid down by the Hon'ble Apex Court in the case of Sanjay Chandra Vs. CBI.
