Continuation of interim order passed by court on issue related to search and seizure
Section 67 of the CGST Act, 2017—Search and Seizure -- The petitioner sought a stay on the investigation and stave off coercive actions undertaken by the respondents. The petitioner submitted that searches have been carried out not only by the Gautam Budh Nagar Commissionerate but also by various Intelligence Units. The court on 17.03.21 directed the respondents to file their reply within next two weeks and meanwhile no coercive measures will be taken against the petitioner. The court observed that presence of one of the counsel has been recorded incorrectly for respondents’ no. 2 to 8, whereas the counsel appeared for respondent 2 and 8.
Held that:- The Hon’ble High Court directed the respondent to file replies within the next four weeks. Interim order dated 17.03.2021 will continue to operate in the meanwhile.
