Suspension of registration on the very day show cause notice was issued, is inexplicable.

Section 29 of the CGST Act, 2017— Registration – The petitioner challenged the order dated 16.01.2021, whereby, its registration has been cancelled. Prior to the issuance of the aforesaid order, a SCN dated 05.01.2021 was issued and the petitioner was called upon to file a reply to the same within seven working days. The said show cause notice ended with a direction that the petitioner’s registration had been suspended from that very date, i.e., with effect from 05.01.2021. The petitioner counsel submitted that the respondents could not have straightaway cancelled the petitioner’s registration, as they were required to suspend the registration and thereafter, if necessary, cancel the same. He referred Rule 21A of the Rules, 2017. The authorized representative of the petitioner had appeared before the concerned officer pursuant to service of the show cause notice dated 05.01.2021. Held that:- The Hon’ble High Court issued notice to the respondents and listed the matter on 12.07.2021.
