The present Anticipatory Bail application filed by the applicant is allowed.

Section 132 of the CGST Act, 2017 — Anticipatory Bail —–The applicant filed anticipatory bail application for the offences under Section 132(1)(a) of the Act, 2017. Investigation was carried out regarding fraudulent transfer of ITC and evasion of huge amount of GST by procuring invoices without actual supply of goods. He applicant counsel submitted that the applicant has been falsely implicated by the Department. He has cooperated with the officials. The applicant has no criminal history and he would not flee away from the trial and will cooperate with the investigation if granted bail. The applicant submitted that the respondent has issued summons to him and he apprehends that he will be arrested if appears in response to the summons. The respondent counsel submitted that the offences committed by the applicant are serious in nature and he has availed ITC without actually receiving the goods. The court observed that the applicant is ready and willing to deposit the amount of Rs. 32 Lakhs with the respondent and he agreed to provide co-operation in the investigation. Held that:- The Hon’ble Court allowed Anticipatory Bail application and ordered that in case the applicant is arrested, he shall be released on bail on furnishing a personal bond of Rs. 15,000/- with a surety of like amount subject to certain conditions including that he would deposit an amount of Rs. 32 Lakhs before the respondent within a period of four weeks.
