List in the month of March 2023. There will be a stay of the impugned order subject to the petitioner depositing Rs. 80 crores with the authorities within a period of sixty days from today.

Section 171 of the CGST Act, 2017-- Anti-Profiteering ––- The court observed that the principle of zeroing is not stated either in the Act or in the Rules. Further, the principle of zeroing has been applied for a period of over six months.

Held that:- The Hon’ble Court issued notice and Listed the matter in the month of March 2023. Further directed that there will be a stay of the impugned order subject to the petitioner depositing Rs. 80 crores, within a period of sixty days. If the petitioner has made an earlier or part deposit, the same will be taken into consideration/ accounted. The deposit will be converted into an interest-bearing Fixed Deposit Receipt for a period of 12 months and will abide by further orders.
