The applicant is entitled to interim anticipatory bail in this case

Section 132 of the CGST Act, 2017 — Anticipatory Bail —–The petitioner sought anticipatory bail against the summoning order dated 26.03.2021 under Section 70 of the Act, 2017. The applicant submitted that he is willing to cooperate with the enquiry and comply with the summons. The court observed that there are no criminal antecedents of the applicant shown as also no real apprehension has been expressed by the respondent counsel. Matter requires consideration. The applicant is entitled to interim anticipatory bail in this case, at this stage. Held that:- The Hon’ble High Court issued notice and listed the matter on 10.09.2021. Further, directed that in the event of arrest of the applicant, he shall be released on interim anticipatory bail during the investigation, till the next date fixed, on his furnishing a personal bond of Rs. 50,000/- with two sureties of the like amount subject to certain conditions.
