In the instant case, the petitioners have essentially challenged the attachment of the bank accounts. By way of interim relief, the above attachment is suspended of both the bank accounts.
Section 83 of the CGST Act, 2017 — Provisional Attachment of Bank Accounts – The petitioner was issued a notice dated 27.2.2018 under section 74(1) of the Act, estimating total tax and other liabilities at Rs. 30.88 lacs. The respondent on 27.2.2018, provisionally attached bank accounts. On 19.3.2018, a further notice was issued under section 74 for total taxes and other dues at Rs. 1.29 crores. The petitioners challenged the attachment of the bank accounts as also the further notice dated 19.3.2018. The counsel for the petitioner submitted that even before the final assessment is made, the authorities have exercised drastic powers of attaching the bank accounts.
Held that:- The Hon’ble High Court issued Notice returnable on 12.4.2018. By way of ad interim relief, suspended the attachment of both the bank accounts on the condition that the balance as on today in both the bank accounts shall be maintained and the petitioners shall maintain a minimum stock balance of Rs. 50 lacs.
