Section 132 of the CGST Act, 2017 — Anticipatory Bail —–The applicant sought anticipatory bail, in respect of summon dated 10.03.2021 in connection with a case under Section 132(1) Clause (a) (b) (c) (d) of the Act. The counsel for the applicant submitted that he has falsely been implicated in this case. He has no criminal history to his credit. Investigation is going on and no charge-sheet has been submitted till date. The respondent counsel submitted that in view of the seriousness of the allegations made against the applicant, he is not entitled to grant of anticipatory bail. The court observed that considering the nature of accusation and his antecedents and also the second surge in the cases of coronavirus and possibility of further surge of the pandemic, the applicant is entitled to be released on anticipatory bail for limited period.
Held that:- The Hon’ble High Court directed that in the event of arrest, the applicant shall be released on anticipatory bail till cognizance is taken by the Court, on furnishing a personal bond of Rs. 50,000/- with two sureties each in the like amount and subject to certain conditions.
