Section 69, 132 and 135 of the CGST Act, 2017—Arrest ---The petitioner prayed for directions declaring Sections 69 and 132 being arbitrary and ultra vires the Constitution of India; and/or declaring Section 135 against the basic criminal jurisprudence and ultra vires the Constitution of India; and/or declaring Sections 16 (2) (c) ultra vires the Constitution of India. The court observed that since vires of provision of the Act, 2017 have been challenged, let notices be issued to Attorney General of India and the Advocate General of State of U.P. The respondent counsel prayed for four weeks' time to file their respective counter affidavits.
Held that:- The Hon’ble High Court granted time for filing reply and directed to list the matter along with writ Tax No.688 of 2020.
