Section 132 of the CGST Act, 2017 – Anticipatory Bail -- The applicant sought anticipatory bail for the offence under Section 132 of the Act. It is alleged that the applicant has created several companies from his office address and issued invoices amongst each other in a circular manner which in commercial parlance is termed as “Circular Trading/Transactions” without any supply of goods or services to these firms and thereby enabling these companies, controlled, operated and managed by him to avail and utilize the input Tax Credit. The applicant submitted that he is permanent resident of Mumbai and ready to co-operate with investigation machinery. He has good antecedent and belong to respectable family. There are no criminal antecedent to his discredit. The court observed that the conduct of the applicant not appearing before respondent for the purpose of inquiry /investigation and not adhering to interim order granted by his learned predecessor disentitle him from consideration of present anticipatory bail.
