This Court is of the opinion that this is a fit case to exercise the discretion and enlarge the applicant on regular bail.

Section 132 of the CGST Act, 2017 —–Bail —- The applicant presently in custody, has filed bail application for the alleged offence punishable under Sections 132(1)(b) and 132(1)(c) of the Act. The issue in the present case is with respect to availment of fraudulent credit. The court observed that the applicant is in custody since 22.08.2021. Investigation is concluded as the complaint has been filed. The co-accused who were also part of the system in claiming fraud ITC, have been enlarged on default bail. The maximum sentence of 5 years. The applicant is ready and wiling to deposit an amount of Rupees One Crore Only within the period of six months;

Held that:- The Hon’ble High Court granted bail to the Applicant subject to certain conditions.
