It is not open for the petitioner to challenge the terms and conditions of the agreement signed by it. This court does not find it a fit case for grant of mandamus. The writ petition is, accordingly, dismissed.

User Charges by Mandi Samiti ——The petitioner sought a direction to the respondents authorities to not to compel the petitioner from depositing further amount in pursuance to the allotment letter. The petitioner has offered a bid for shop in the Mandi and for shop no.66 was accepted as the highest bid. The allotment letter dated 27.07.2021 has been issued to the petitioner to deposit the remaining premium amount. The court observed that there is no statement in the writ petition that the respondent is charging user charges beyond the terms and conditions of the agreement.

Held that:- The Hon’ble High Court dismissed the petition.
