Section 83 of the CGST Act, 2017— Provisional Attachment of the Bank Accounts -- The petitioner challenged the order of attaching the bank accounts under Section 83. The petitioner counsel submitted that the Hon'ble court vide order dated 03.03.2021 has observed that the GST liability of the petitioner company is Rs. 20.22 crores, which includes the principal amount of Rs. 17.26 crores along with interest amounting to Rs. 2.96 crores. Out of the said amount the petitioners have deposited a total of Rs. 15,68,70,000/-. The remaining principal amount i.e. Rs. 1,57,30,000/ shall be paid on or before 25th October, 2021. The interest comes to Rs. 3,78,80,747/- and the same shall be deposited in two equal instalments. The respondent counsel submitted that the principal amount outstanding as of today is actually is Rs. 2,00,15,367/- and further Rs. 10 lacs has not been paid on 13.09.2021 as contended by learned senior counsel for the petitioner.
Held that:-The Hon’ble High Court directed the petitioner to produce proof of payment of Rs. 10 lacs on record along with an affidavit within two weeks. Further directed that the correct outstanding amount and the interest payable thereon shall be determined on the next date of hearing on 24th January, 2022.
