Section 83 of the CGST Act, 2017 –– Provisional Attachment –– The Counsel for the Petitioner submitted that the impugned order of provisional attachment, which is contrary to the dictum laid down by the Hon’ble Supreme Court of India in the decision in Radha Krishan Industries has to be immediately stayed so that the Petitioner could operate its bank accounts for effectively carry on its business. The respondent counsel submitted that the Petitioner has also filed another Writ Petition in W.P. No. 2723 of 2021 in respect of the same matter. The petitioner counsel sought time to get instructions from the Petitioner in that regard.
Held that:- The Hon’ble High Court posted the matter along with W.P. No. 2723 of 2021 on 12.05.2021.
