GST on Royalty on Mining ——–The petitioner counsel submitted that in identical matters pending before Allahabad High Court, two interim orders are passed. The petitioner has pressed the ground of parity. Similarity of the issue and operation of the interim orders passed by this Court at Allahabad are not disputed by the counsel appearing for opposite parties. The court observed that as have been recorded in the order dated 15.11.2021 passed in M/s A.D. Agro Foods Private Limited vs. Union of India, the payment of GST for grant of mining lease/royalty by the petitioner shall remain stayed.

Held that:- The Hon’ble High Court granted six weeks time to Parties to exchange affidavits and directed to list thereafter.
