Section 83 of the CGST Act, 2017 —-Provisional Attachment of Bank Accounts —– The applicant prayed for a direction to quash impugned orders dated 11.03.2021, 16.03.2021 and 12.10.2021 purporting to attach the bank accounts of the petitioner and impugned order dated 29.06.2021 in rejecting the representation filed by the petitioner. The court observed that as on date, the aggregate of Rs. 2,37,13,192.96 is lying to the credit of the writ-applicant in the three bank accounts. After the three orders came to be passed under Section-83 of the Act, the writ-applicant filed a representation under Rule 159(5), which was considered and ultimately came to be rejected. The counsel for the petitioner submitted that his client is ready and willing to furnish the bank guarantee to the tune of Rs. 1.25 Crore.
Held that:- The Hon’ble High Court directed the respondent no.2 to de-freeze the three bank accounts upon the writ-applicant furnishing a bank guarantee of Rs. 1.25 Crore and individual undertakings of the Directors of the company. The bank guarantee shall continue till the statutory time period of all the three orders passed under Section-83 of the Act comes to an end.
