This court is not inclined to grant concession of bail to the applicant/ accused at this stage and the bail application of the accused is hereby dismissed.
Section 132 of the CGST Act, 2017—Bail -- The applicant prayed for bail. The applicant counsel submitted that the applicant is in custody since 04.02.2021 and the complainant department after the completion and conclusion of investigation has filed the complaint for offences punishable under Section 132 (1) (b) (c) & (i) of the Act on dated 02.04.2021. The applicant / accused has never avoided to participate in the investigation and no fruitful purpose would be served by continued detention of the applicant/ accused. The case is based upon documentary evidence, challan/ complaint has already been filed and the trial shall take long time and no purpose would be served by keeping the applicant behind bars any further. The court observed that though the applicant/ accused is in custody since 04.02.2021, but taking into account the fact that the applicant is involved in a case involving fraud of Rs. 90 crores approximately. This is a grave offence affecting the economy of the country as a whole and thereby posing serious threat to the financial health of the country.
Held that:-The Hon’ble High Court dismissed the bail application.
