This is a economic fraud going to the root of the economy as this Court does not see any justifiable ground for grant of bail.
Section 132 of the CGST Act, 2017— Bail -- The applicant prayed for grant of bail. He was arrested on 18.07.2019. The allegations against him are that he allegedly paid wrongful ITC to the tune of Rs. 87.78 crores and availed wrongful ITC to the tune of Rs. 85.84 crores by way of raising alleged fake invoices. The allegations of claiming of wrongful ITC is false, baseless, incorrect as the applicant has not claimed or has passed the wrongful ITC. The applicant got himself operated for intestine and kidneys and he is not medically fit and required constant observations of the doctors. The respondent counsel submitted that plea for bail had already been dismissed by this Sessions court vide order dated 21.01.2020. There is no fresh ground for bail/interim bail. There is no material change in the circumstances. The court observed that the present accused does not deserve to be released on bail.
Held that:-The Hon’ble Court rejected the bail application.
